Breathspec registered trademark in the US

Imspex Medical is delighted to announce they have registered Breathspec as a trademark in the USA.

Following a lengthy application process, the new trademark now gives our Breathspec product and technology more protection than before with the US market.

How do you register a trademark in the USA?

There are 4 main steps to registering a trademark in the US:

Register in the UK first
You must first be registered in the country that you originate. So for Imspex Medical, we had to register Breathspec in the UK first.

Hire a US trademark attorney
All foreign trademark applications are required to be represented by a US attorney, a beneficial part of the process in which to respond to office actions on your behalf.

File your trademark application
Once an attorney is appointed, you can move forward in submitting your application, usually directly to the USPTO (United States Patent & Trademark Office) or through a third party.

Meet the deadlines
Throughout the process, the USPTO may ask for additional information or have questions relating the application and will set deadline for the information to be received. Being late with responses may result in the application being cancelled.

Why do you need a trademark?

There are a few key reasons why you need a trademark for a product or service:

Identifies the source of the product
Gives your product legal protection against fraud or counterfeiting
The right to take action against someone attempting to register conflicting trademarks
Develops intrinsic value for investment
Protecting our brand identity
Easier for consumers to identify us
Besides now being able to use the small ® symbol next to our name, we wanted to protect our Breathspec brand for future expansion.

What is Breathspec?

From the horse’s mouth, Breathspec is a rapid, non-invasive, cost-effective, analytical device for bacterial or viral infection diagnosis through ultra-high sensitivity breath analysis. You may be aware of antimicrobial resistance and the threat that it poses to our planet of humans, animals and plants with resistance to antibiotics and other treatments growing for certain health conditions. Breathspec aims to be part of the effort to change that resistance, diagnosing patients more specifically through its technology to personalise a treatment plan for specific conditions, whilst protecting overuse of our drugs.

Breathspec uses ground-breaking technology of combining Gas Chromatography (GC) and Ion Mobility Spectrometry (IMS) to form GC-IMS analysing chemistry results with integrated software identifying volatile organic compound signatures and linking them to disease indicators.

The design is entirely non-invasive and produces fast, accurate results with our studies showing a sensitivity of 95% and specificity of 95% in detecting Covid-19 and accuracy as good as or better than standard of care evaluations when identifying Covid-19 or differentiating between bacterial and viral causes of respiratory tract infection.

Dr Michael Graz, Chief Scientific Officer at Imspex Diagnostics said: “We’re clearly very proud of our Breathspec technology and so are delighted to be protecting it further with a trademark in the USA. Even more so because we have some exciting research and projects in 2022 that will allow us to share this technology much more widely.”
